Sec. 804 — Elimination of late cost and pricing data submission defense

Section 3706(c) of title 10, United States Code, is amended—(1)in paragraph (3) by striking or at the end;(2)in paragraph (4) by striking the period and inserting ; or; and(3)by adding at the end the following:(5)updates to cost or pricing data submitted by the prime contractor or subcontractor after the date of agreement on the price of the contract (or price of the modification) or, if applicable and if consistent with subsection

(a) (2), such other date agreed upon between the parties, were based on data that was more than 30 days old..
