(a) Eligibility of a member already subject to a period of obligated serviceSection 710 of title 10, United States Code, is amended, in subsection (a), by adding at the end the following new paragraph:

(3) The Secretary of a military department may not prohibit a member from inactivation under this section solely on the basis that such member is subject to a period of obligated service on active duty other than a period of service under subsection

(c) (3)..

(b) Minimum length of program. Such section is further amended, in subsection

(b) (1), by inserting and the minimum period shall be one month after may not exceed three years.
