Sec. 2808Expansion of annual report on unfunded requirements for certain military construction projects

Statutory text

Section 2806 of the National Defense Authorization Act for Fiscal Year 2018 (Public Law 115—91; 10 U.S.C. 222a note) is amended—(1)by striking The Under Secretary of Defense for Research and Engineering and inserting the following:

(a) In general. The Chief of Staff of the Army, the Chief of Naval Operations, and the Chief of Staff of the Air Force, in coordination with the Under Secretary of Defense for Research and Engineering;(2)by striking order and all that follows through the end of the section and inserting order.; and(3)by adding at the end the following new subsections:

(b) Elements. Each report required under subsection (a) shall include, for each military construction project listed in the report—(1)a description that identifies the objectives of the national defense strategy required under section 113(g) of this title and the National Military Strategy required under section 139(b) of this title that would be advanced if the military construction project were funded, in whole or in part;(2)a detailed assessment of each specific risk to the execution of the national defense strategy and the National Military Strategy that would be reduced the military construction project were funded, in whole or in part; and(3)a Department of Defense Form 1391.

(c) Consistency with military construction requirements. Information regarding project scope, cost estimate, and design maturity for military construction projects included in a report under subsection (a) shall be prepared and validated in a manner consistent with the requirements applicable to military construction projects included in the budget of the President submitted to Congress under section 1105(a) of title 31.

(d) Certification. The Secretary of the military department concerned shall certify each military construction project under the jurisdiction of the Secretary that is listed in a report required under subsection (a) as—(1)a valid unfunded military construction requirement of the military department; and(2)appropriate for consideration by Congress as part of the unfunded priorities of the military department..
